Eurotel Limited (“Eurotel”)
Conditions of Use of Eurotel’s eFax service:
These Conditions of Use are supplemental to Eurotel’s standard terms and conditions applicable at the date of Order (“the Terms and Conditions”) as they apply to the provision of Network Services by Eurotel to its Customers. These Conditions of Use will apply (pursuant to clause 5.4.1(a) of the Terms and Conditions where a Customer makes an Order for the service supplied by Eurotel called eFax (“the Service”). These Conditions of Use apply in addition to the Terms and Conditions however, in the event of a conflict between the Terms and Conditions and these Conditions of Use, these Conditions of Use shall prevail. Terms defined in the Terms and Conditions shall have the same meaning in these Conditions of Use unless otherwise stated here.
- In these Conditions of Use “Intellectual Property” means patents, trade marks, design rights, copyright (including rights in computer software and databases), know how and moral rights and other intellectual property rights, in each case whether registered or unregistered and including applications for, and the right to apply for, the foregoing and all rights or forms of protection having equivalent or similar effect to any of the foregoing which may subsist anywhere in the world.
- The Customer acknowledges and accepts that ownership of any numbers supplied by Eurotel for use with the Service shall not pass to the Customer. In the event that any numbers supplied by Eurotel are not used for a period of 3 months (in total within 12 months or consecutively), Eurotel reserves the right to withdraw such numbers immediately or otherwise if Eurotel is required by the Carrier to withdraw such numbers for any reason whatsoever. Eurotel shall have the right to change such numbers upon notifying the Customer of the same without liability for any costs or losses associated with any such change.
- Without prejudice to any other obligation of the Customer under the Terms and Conditions, the Customer shall:
- use the Service as an end-user only and not as a reseller and under no circumstances shall the Customer use the Service for commercial gain whatsoever;
- use the Service in accordance with any direction of the relevant regulatory authorities as may affect the provision of the Service and any other competent governmental authority;
- not use the Service in a manner which violates or infringes the rights of any person including, without limitation, infringing any Intellectual Property Rights (including, without limitation, breach of copyright) of any person;
- not cause or permit anything to be done which may damage or endanger the Intellectual Property Rights of Eurotel and/or the Carrier relating to the Service; and
- promptly and fully notify Eurotel of any actual, threatened or suspected infringement of any Intellectual Property Rights relating to the Service and shall assist Eurotel or the Carrier in respect of any claims brought or defended by them in respect of the same.
- Without prejudice to any other rights of Eurotel under the Terms and Conditions or in law, Eurotel shall be entitled to suspend the provision of the Service (in whole or in part) at its sole discretion and without notice in the event that:
- it suspects that the Customer is using or causing or permitting the use of the Service in breach of the Terms and Conditions and/or these Conditions of Use; or
- the Carrier needs to carry out work relating to the upgrade or maintenance of any systems used to provide the Service.
